IMPORTANT -- READ CAREFULLY: BY CREATING AN ACCOUNT OR BY UTILIZING THE CONTAKER YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.

Welcome to the Contaker, website and mobile application. Contaker™ is a product of LLC Data House (129090, Malaya Sukharevskaya sq., 3, Moscow Russian Federatioin, apt III-2). Your use of the Contaker is subject to these Terms of Use. These Terms of Use are a legal agreement between You and Contaker for use of the Contaker service. If You do not agree with the terms of use, do not use the Contaker. Contaker reserves the right to update and change the terms of use from time to time without notice or acceptance by You. By using the Contaker, You signify Your irrevocable acceptance of this terms of use. The website and any downloadable software associated with the Contaker are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

Description of Service

The Contaker includes, and is limited to, a service, web site, or mobile application that allows You access to and use of a single Contaker Account. "Contaker" referred to herein means an online tool that keeps and combines all your precious contact information in one place and allows to transfer contacts without efforts. The Contaker may contain information about your contacts generated, provided, or otherwise made accessible on or through the Contaker (collectively, “Content”). Subject to these Terms of Use, Contaker grants to You and each user of the Contaker a worldwide, non-exclusive, non-sublicensable and non-transferable license to use Content solely for purposes of using the Service. Usage, reproduction, modification, distribution or storage of any Content for other than purposes of using the Contaker is expressly prohibited without prior written permission from us.

Registration

In order to use the Contaker, You must have a valid Account. To acquire an Account for the Contaker, You must provide with an phone number. You are responsible for maintaining the confidentiality of the access data for Your Account, and are fully responsible for all activities that occur under Your Account. You agree to (a) immediately notify Contaker of any unauthorized use of Your Account or any other breach of security, and (b) ensure that You exit from Your Account at the end of each session. Contaker cannot and will not be liable for any loss or damage arising from Your failure to comply with this section. By using the Contaker (and registering an Account on the Contaker), You represent and warrant that You are at least 16 years of age, and no one under the age of 16 may use the Contaker. Contaker is not directed to children, and we expect that any use by children will only be done with the guidance, supervision and consent of their parents, guardians. Contaker relies on parents and guardians to ensure that minors only use Contaker if they can understand their rights and responsibilities as laid out in these Terms of Use and in our Privacy Policy. Contaker may, in its sole discretion, refuse to offer the Service to any person or entity and change its eligibility criteria at any time.

You represent and warrant that You have all necessary right, power and authority to enter into these Terms of Use and to perform the acts required of You hereunder.

Proper Use

Contaker does not claim ownership over any User Content (contacts) submitted on or through the Contaker. Your User Content belongs to You.

You understand that all User Content (contacts) is the sole responsibility of the person from which such User Content originated. This means that You, and not Contaker, are entirely responsible for all User Content that You upload make available via Your Account. Contaker does not control the User Content posted via the Service.

To modify or delete the personal information you have provided to us, simply log into the Contaker and press “Delete Account” button. On request, we'll provide you with a copy of your personal information that we maintain (press to “Export Personal Data” button).

License Restrictions

You may not make or distribute copies of the Contaker Software, or electronically transfer the Contaker Software from one computer to another or over a network. You may not decompile, reverse engineer, disassemble, or otherwise reduce the Contaker Software to a human-perceivable form. You may not rent, lease or sublicense the Contaker Software. You may not modify the Contaker Software or create derivative works based upon the Contaker Software.

Security

While no service is completely secure, we have a security team dedicated to keeping your information safe. We employ security measures such as using firewalls to protect against intruders, building redundancies throughout our network (so that if one server goes down, another can cover for it) and testing for and protecting against network vulnerabilities.

Upgrades

If this copy of the Contaker Software is an upgrade from an earlier version of the Contaker Software, it is provided to you on a license exchange basis. You agree by your installation and use of this copy of the Contaker Software to voluntarily terminate your earlier end-user license and that you will not continue to use the earlier version of the Contaker Software nor transfer it to another.

Non-Competitive Agreement

The product cannot be used for competitive purposes in any manner. It is agreed that any reverse engineering, be they direct or created through inspiration, is unlawful and strictly forbidden. Moreover, you agree that in no such manner have you the ability to use our software nor source codes, in whole or in any part, and that in such doing, you will be in violation of our agreement and subject to punishment by law.

General

This Agreement contains the complete agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
